Terms and Conditions

Last updated: July 3, 2026 · Version 1.0

These Terms and Conditions govern access to and use of Radarial. We ask that you read them carefully: by using the Service, you agree to be bound by them.

1. Parties

These Terms and Conditions (the "Terms") govern access to and use of the platform and services provided under the Radarial brand (the "Service"), operated by Novalab S.A., a company incorporated in the Argentine Republic, CUIT [to be completed], with registered address at [to be completed], as the owner of the Service and its intellectual property (hereinafter, "Radarial", "Novalab" or "we", used interchangeably).

Radarial and the User (as defined below) are collectively called the "Parties" and individually a "Party".

2. Definitions

For the purposes of these Terms:

"Service" or "Platform": the set of media monitoring tools that Radarial makes available to the User, including tracking, indexing, transcription, organization and visualization of content from publicly accessible sources, as well as related dashboards, reports, alerts and functions.

"Site": the website of the Service hosted at radarial.com, together with its subdomains and associated applications.

"Public Sources": the publicly accessible media and channels that Radarial indexes, such as news portals, social networks, television, radio and video platforms, among others.

"Indexed Content": the information from Public Sources that Radarial tracks, processes and organizes for consultation through the Service.

"Radar": the configuration defined by the User (for example, a topic, a brand, a spokesperson, a keyword or a region) on which the Service performs monitoring.

"Results": the mentions, transcriptions, summaries, analyses, timestamps, alerts, dashboards and other outputs that the Service generates from Indexed Content based on the User's Radars.

"Plans": the modes of access to the Service, whose characteristics, scope, limits and current prices are published on the Site.

"User": any natural or legal person who accesses or uses the Service, in their own name or on behalf of a third party, and at their own cost.

"Account": the personal and non-transferable registration through which the User accesses the Service.

3. Acceptance, validity and modifications

By accessing the Site, registering, purchasing a Plan or using the Service in any way, the User declares having read, understood and accepted these Terms and the Privacy Policy, which forms an integral part hereof, with both Parties being legally bound.

These Terms indicate their last update date. Radarial may modify them at any time. Material changes will be notified by reasonable means (for example, within the platform or by email) and will become effective on the date indicated. Continued use of the Service after such effective date implies acceptance of the changes.

These Terms remain in force while the User uses the Service and/or maintains an active Account or Plan.

4. Service description

Radarial is a media radar for Latin America. The Service continuously monitors Public Sources—digital newspapers and portals, social networks, television, radio and video platforms, among others—and shows the User what is being said about the topics, brands or spokespersons configured in their Radars, where it is being said and in what tone.

The Service may include, depending on the Plan and Channel, audio and video transcription with timestamps, mention detection, summary and analysis generation through artificial intelligence, identification of figures and spokespersons, dashboards, exportable reports and alerts.

The scope, limits and available functions depend on the Plan and are described on the Site. The Service may be modified, expanded or discontinued in the future.

5. Information sources and third-party content

Radarial indexes information from Public Sources, that is, content that is openly and publicly accessible. On that basis, we organize and serve that information so it can be consulted by our Users—journalists, companies, agencies and professionals—for monitoring, analysis and information purposes.

We conduct this activity cleanly and responsibly: we process only publicly accessible content, for the purpose of indexing it, referencing it and facilitating its discovery and analysis, in compliance with applicable law.

Indexed Content and intellectual property rights over the original works belong to their respective owners or sources. Radarial does not claim ownership of such content; the Service acts as a monitoring, reference and analysis tool, not as a substitute for consumption of the original sources.

Responsible use of Results. The User is obligated to use the Results in accordance with the law and the rights of third parties. The reproduction, redistribution or commercial exploitation of third-party content outside the monitoring and analysis use provided for in these Terms is the sole responsibility of the User, who must obtain the necessary authorizations.

6. Registration, accounts and authentication

Registration. To use the Service, the User must create an Account and provide truthful, complete and current information. The User is responsible for the accuracy of the information supplied.

Account responsibility. The Account is personal and non-transferable. The User is responsible for maintaining the confidentiality of their credentials and all activity under their Account, and must notify us immediately of any unauthorized use. Radarial is not responsible for Account use by third parties.

Business use. When the User accesses the Service on behalf of a company or organization, they declare having sufficient authority to bind that entity to these Terms.

7. Permitted and prohibited use

The User is obligated to use the Service in accordance with these Terms, in good faith and applicable law. In particular, the User is obligated not to: (i) reverse engineer, decompile, scrape or improperly exploit the Service or its infrastructure; (ii) resell, sublicense or make the Service available to third parties outside of their Plan; (iii) use the Service to illegitimately monitor, profile or harm persons, or for discriminatory, defamatory or unlawful purposes; (iv) compromise the security or integrity of the Service or interfere with its normal operation; or (v) assist third parties in any of said conduct.

8. Plans, payments and billing

Some Plans are free or trial and others require payment. The characteristics, limits and current prices of each Plan are published on the Site and may change; the current version is that published at the time of subscription or use. Plans may be structured by scope (for example, by country, region or all of Latin America) and by monitoring volume.

Taxes. Published prices may not include taxes, which shall be borne by the User as applicable.

Payment processors. Payments are processed through external providers (for example, local and international payment processors). Such providers may require and process data in accordance with their own policies, which the User must review.

Renewal and cancellation. Unless otherwise indicated, subscriptions renew automatically for equivalent periods. The User may cancel renewal at any time from their Account or by contacting support; absent legal provision to the contrary, cancellation does not generate refund of the period already paid.

Consumer rights. Users who are consumers enjoy the rights recognized by applicable law, including, when applicable, the right of withdrawal provided for in Argentina's Consumer Protection Law (Ley 24.240).

9. Cancellation and suspension

The User may cancel their Plan or delete their Account at any time from the platform or by contacting support.

If the User breaches, in whole or in part, these Terms or the Privacy Policy, Radarial may suspend or terminate the Account temporarily or permanently, without incurring liability. Whenever possible and in accordance with applicable law, the User will be notified.

10. Intellectual property

Radarial, its brand, logos, software, design, databases, dashboards and other Service components are owned by Novalab S.A. or its licensors, and are protected by applicable law. Their reproduction, use or commercialization without proper authorization is prohibited.

The brands, names and content of third parties mentioned or indexed in the Service belong to their respective owners.

11. Accuracy, availability and service levels

Accuracy. Some of the Results are generated through artificial intelligence technology and automated processes, and may contain errors, omissions or inaccuracies (for example, in transcriptions, summaries or classifications). The User accepts that Results may not be accurate, current or complete, and their use for any purpose is entirely at the User's risk. The Service does not replace the User's professional judgment or verification in original sources.

Availability. The Service is provided "as is" and "as available". Radarial endeavors to maintain continuous and secure operation, but does not guarantee that the Service will be free from interruptions or errors. Coverage of Public Sources may vary and depends on the availability and access conditions of each source.

12. Privacy and data

The processing of personal data is governed by the Privacy Policy, available at radarial.com, which forms an integral part of these Terms. At Radarial we do everything cleanly and securely: we do not sell or share the personal data of our Users with third parties.

13. Business use (B2B) and API

Services for businesses, including corporate plans, integrations and API access, may be governed by a specific commercial agreement that complements these Terms. In case of conflict regarding business use, such agreement prevails.

14. Indemnification

The User will hold harmless Radarial, Novalab S.A., its affiliates, directors and employees against any claim, demand, damage, loss, cost or expense (including attorney fees) arising from their use or misuse of the Service or Results, or breach of these Terms, the Privacy Policy or the law.

15. Limitation of liability

To the maximum extent permitted by law, Radarial will not be liable to the User or third parties for indirect damages, lost profits, lost opportunity, data loss or any other loss arising from use, misuse or inability to use the Service or Results. Nothing in these Terms limits the non-waivable rights that the law recognizes for consumers.

16. Force majeure

Radarial will not be liable for breaches or delays caused by force majeure or acts beyond its reasonable control.

17. Relationship between Parties, severability and waiver

These Terms do not constitute and shall not be interpreted as a partnership, agency, employment relationship or joint venture between the Parties.

If any provision of these Terms is deemed invalid or unenforceable, it will be replaced by a valid one that pursues the intention of the Parties, and the remaining provisions will remain in full force. Radarial's failure to exercise a right will not imply waiver of that or other rights.

18. Applicable law and jurisdiction

These Terms are governed by the laws of the Argentine Republic. For any controversy arising from these Terms or the use of the Service, the Parties submit to the jurisdiction of the competent ordinary courts of the Argentine Republic.

Consumers. The above does not deprive Users who are consumers of the protection of mandatory rules or the forums recognized by the law of their country of residence.
